Most debts are dischargeable through bankruptcy, and a bankruptcy discharge would provide you with a financial fresh start whereby you can regain control of your finances and begin rebuilding your credit.
A Chapter 7 filing may allow you to obtain a discharge of debt in as little as 90-120 days. And contrary to many popular bankruptcy myths, the vast majority of people who file retain all of their assets. This is possible because both Federal and State laws allow you to exempt out of the bankruptcy certain amounts of your assets in order to create what are called “no asset” cases.
A Chapter 13 filing consists of a payment plan over 3-5 years, in which all of your debts are consolidated into one monthly payment made to the Chapter 13 Trustee. If you have missed payments on your mortgage and are facing foreclosure, a Chapter 13 filing may give you the ability to prevent a foreclosure and keep your home.
